12.12.2023 Reports from whistleblowers can be very valuable in helping to uncover or prevent legal violations. In order to protect whistleblowers and ensure that insider knowledge of existing misconduct is passed on without fear of retaliation, the Whistleblower Protection Act obliges companies and authorities to set up secure reporting channels and prohibits reprisals against whistleblowers. In other words, the Whistleblower Protection Act (HinSchG) is intended to strengthen the protection of whistleblowers and at the same time ensure that they are not at risk of being penalised. This law transposes the EU Whistleblower Directive into German law. From 17 December 2023, the establishment of an internal whistleblowing office will be mandatory for companies with at least 50 employees.
